Please read these Terms of Service (“Terms”) carefully before using nexgenelevationhub.tech, nexgenelevationhub.com, or the NexGen learning platform (together, the “Service”), operated by NexGen Elevation Hub (“NexGen,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service is intended to support K-12 students, parents, educators, and schools. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian, or through your school’s authorized use of the platform. If you are a parent creating an account for your child, or a school representative creating accounts for students, you represent that you have the authority to do so and to agree to these Terms on that student’s behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at nexgenelevationhub@gmail.com if you suspect any unauthorized use of your account.
You agree to provide accurate and complete information when creating an account and to keep that information up to date.
We grant you a limited, non-exclusive, non-transferable right to access and use the Service for personal, educational, or school-related purposes, subject to these Terms. You agree not to:
Any curriculum, materials, branding, and content made available through the Service are owned by NexGen or our licensors and are protected by copyright and other intellectual property laws. You may not reproduce or distribute this content outside the Service without our written permission.
If you or your child submit content through the Service, such as a response to an assignment, you retain ownership of that content, but you grant NexGen a license to use, store, and display that content as needed to operate and improve the Service.
Where the Service is used by a school or district, our collection, use, and sharing of Student Data is governed by our agreement with that school, our Privacy Policy, and applicable law, including FERPA and COPPA. Schools are responsible for providing any parental notice or consent required by applicable law before a student uses the Service.
Where a parent creates an account directly, the parent is responsible for supervising their child’s use of the Service and for the accuracy of information provided.
If you purchase a paid plan, you agree to pay all fees associated with that plan as described at the time of purchase. Fees, features, and plan availability may change, and we will provide notice of material changes affecting your subscription where required. Unless otherwise stated, fees are non-refundable.
We may suspend or terminate your access to the Service if we believe you have violated these Terms, or for any other reason, with or without notice. You may stop using the Service or request account deletion at any time by contacting us.
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, NexGen disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by law, NexGen and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid to NexGen, if any, in the twelve months before the claim arose.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Harris County, Texas.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site with a new effective date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
